What is the process for filing a special education complaint against a school district?

If you believe the school district is violating the educational rights of your child and you cannot come to a resolution with school officials, you have the right to file a complaint with the Texas Education Agency (TEA). Your complaint must be filed within one year of the alleged violation. TEA must review, investigate, and resolve complaints within 60 calendar days. You can find more information about filing a complaint from TEA here or from Disability Rights Texas here. If you and the district cannot come to an agreement about special education services, you also have the right to request a mediation. Mediation is an informal and voluntary process conducted by an impartial mediator. Requests for mediation should be made in writing to TEA. Be sure to include in your request for mediation: your child’s name and grade, the name of the school district (or charter school), a brief description of the issues you would like mediated, and how you can be contacted.
