Out-of-school suspensions are limited to three school days per Section 37.005(a) of the Texas Education Code. Your child cannot be suspended out-of-school for longer than three school days. Students experiencing homelessness or in grades 3 and under may not be placed in out-of-school suspension unless they are found to have committed an offense outlined in Sections 37.005(c) and (d) or the Texas Education Code. However, unlike out-of-school suspensions, in-school suspensions (ISS) are not limited. This means that your child’s principal can decide to send your child to ISS for three school days, 10 school days, or even 15 school days—there are no limits imposed by the Texas Education Agency (TEA) nor any listed in the Texas Education Code. If you think this is unfair, contact your legislators and tell them to address this issue in the Texas Education Code.
